This Manual is prepared for Westrust (Pty) Ltd (registration number 1993/004000/07), trading as Westrust, in accordance with section 51 of the Promotion of Access to Information Act, 2 of 2000 (PAIA), as amended. The purpose of this Manual is to assist requesters to understand what records may be held by Westrust and how requests for access to records may be made.
This Manual must be read together with PAIA, POPIA, applicable regulations, and guidance issued by the Information Regulator from time to time.

The Information Regulator has compiled a guide in each official language to assist persons who wish to exercise rights under PAIA and POPIA. The guide explains, among other things, how to make a request for access to a record, available remedies, and how to lodge a complaint with the Regulator.
The guide may be obtained from the Information Regulator through its official website or contact channels.
Westrust may hold records in terms of legislation and regulatory frameworks applicable to its business and professional operations, which may include, depending on context and amendments from time to time, company law, labour and employment law, tax legislation, value-added tax legislation, professional and regulatory obligations, insolvency and restructuring-related legislation, anti-money laundering obligations, and record-keeping obligations imposed by general commercial law.
The inclusion of legislation in this Manual does not automatically mean that a requester is entitled to access all records held in terms of that legislation. Access must still be considered in accordance with PAIA and any other applicable law.
Westrust may hold records in the following broad categories. The listing below is not exhaustive and a category does not guarantee automatic access:
Unless otherwise determined by Westrust from time to time, the following categories of records may generally be available without a formal PAIA request, subject to operational availability and lawful restrictions:
Westrust may still require identification, confirmation of purpose, or reasonable administrative steps before furnishing a copy of any record, and may charge prescribed or reasonable reproduction fees where lawfully applicable.
A requester seeking access to a record held by Westrust must submit a request using the prescribed PAIA request form (currently Form 2 under the applicable PAIA Regulations) and provide sufficient detail to enable Westrust to identify the record requested and the requester's right of access.
Requests should be submitted to the Information Officer at [email protected]. The requester should clearly mark the correspondence as a PAIA request.
If a request is made on behalf of another person, proof of authority must be provided. If the requester is unable to complete the request in writing because of illiteracy or disability, reasonable assistance should be sought in accordance with PAIA.
Access to records may be subject to the prescribed request fees, access fees, reproduction fees and, where applicable, deposits permitted under PAIA and the Regulations. Westrust reserves the right to require payment of applicable fees before processing or releasing records where the law allows it to do so.
The applicable fee position will depend on the nature of the requester, the nature of the request, the volume of the record, reproduction costs and the governing regulations in force at the time of the request.
Westrust will assess each request in accordance with PAIA. Access may be refused, limited or deferred where PAIA permits or requires this, including where the record contains personal information of another person, commercially confidential information, privileged material, legally protected records, confidential third-party information, records relevant to legal proceedings, or information the disclosure of which would otherwise be unlawful or prejudicial.
Where only part of a record may be disclosed, Westrust may grant partial access by severing or redacting protected portions where reasonable and lawful.
Westrust processes personal information in the ordinary course of its business, administration, recruitment, website operation, professional service delivery, compliance and relationship management activities. The categories of data subjects and personal information processed may include employees, job applicants, clients, prospective clients, service providers, business contacts and website users.
A fuller description of website-related processing appears in the Westrust Privacy Policy. Internal processing records may be expanded separately for operational compliance purposes.
This Manual will be made available as required by law, including publication on the Westrust website where appropriate. A requester may also ask for a copy using the published contact details. At minimum, a digital copy should be made available free of charge; a reasonable reproduction fee may be charged for printed copies where lawful.
If a requester is dissatisfied with the outcome of a PAIA request, or if Westrust fails to respond within the applicable time period, the requester may pursue such remedies as are available under PAIA, which may include lodging a complaint with the Information Regulator or approaching a court of competent jurisdiction where appropriate.
